1. Agreement to Terms

By accessing or using AlmostHeavenGold.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We reserve the right to update these Terms at any time; continued use of the Service after changes constitutes your acceptance of the revised Terms.

2. Description of Service

Almost Heaven Gold provides a subscription-based platform displaying West Virginia DNR trout stocking data on an interactive map, with optional SMS notifications for paid members. Data is sourced from the WV DNR website and is provided for informational purposes only. We make no guarantees about the accuracy, completeness, or timeliness of stocking data.

3. Accounts

• You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials.
• You must be at least 13 years old to create an account.
• You are responsible for all activity that occurs under your account.
• We reserve the right to terminate accounts that violate these Terms.

4. Subscriptions and Billing

• Monthly plans are billed at $5/month. The annual Founder's Pass is billed at $20/year. Founder's Pass holders lock in their $20/year rate for the lifetime of their subscription — this price will not increase as long as the subscription remains active.
• Subscriptions renew automatically at the end of each billing period (monthly or annually). You may cancel at any time from your member portal. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time.
• Payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
• We reserve the right to change pricing for new subscribers with reasonable notice. Existing subscribers are unaffected unless their plan is discontinued.

5. SMS Alerts

• SMS alerts are available to paid members who explicitly opt in by checking the SMS consent box in their member profile. By opting in, you consent to receive automated text messages from Almost Heaven Gold.
• The opt-in checkbox is never pre-checked. You must take a distinct, affirmative action to consent to receiving SMS messages.
• Message frequency varies based on WV DNR stocking activity — up to 8 messages per day on weekdays.
• Message and data rates may apply.
• To opt out, reply STOP to any SMS. To request help, reply HELP.
• Opting out of SMS does not cancel your subscription.
• No personal data or mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

6. Free Tier

Free accounts receive access to a map with a 24-hour data delay, date filtering, and one month of stocking history. Free-tier features are subject to change at our discretion. We are not obligated to maintain a free tier.

7. Acceptable Use

You agree not to:

• Scrape, copy, or redistribute our data without written permission.
• Attempt to reverse-engineer, circumvent, or bypass any feature gate or access control.
• Use the Service for any unlawful purpose.
• Impersonate another person or misrepresent your affiliation with any entity.

8. Data Accuracy Disclaimer

Stocking data is sourced from the West Virginia Division of Natural Resources. We make no representations as to the accuracy, completeness, or currency of the data. Always consult official WV DNR sources before making fishing decisions. We are not responsible for missed fishing opportunities, wasted trips, or any other outcome based on data displayed in the Service.

9. Intellectual Property

All content, design, and software comprising the Service — except third-party data (WV DNR) — is owned by Almost Heaven Gold and protected by copyright. You may not reproduce or distribute any part of the Service without prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Almost Heaven Gold and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising from use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

12. Governing Law

These Terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in West Virginia.
